The Illinois Workers’ Compensation Process

If you are injured at work, you should notify your employer immediately. While you have 45 days to report the injury, in most cases it is better to do it right away if you know or think you are injured.

You should seek medical care as soon as possible. Gather all of your medical records from the injury as they will be important information for your workers’ comp claim.

When you submit a workers’ compensation claim, you must use the online Illinois Workers’ Compensation Commission CompFile system. You or your lawyer may file the claim. In the majority of cases, you have three years from the accident or injury to file the workers’ compensation claim. There are some exceptions to this deadline; your attorney will explain whether that applies to you.

If your claim is denied, you can appeal the decision. It is strongly advised that you have a lawyer for this process. Your employer will have legal counsel; you should, too.
